The College of Law / University of Karbala discussed the master’s thesis tagged (Penal jurisdiction to spend work) by the student Hasanin Abdul Wahid Hussein and on the hall of Prof. Dr. Abbas Al-Husseini in the college,
The aim of the message was to determine the jurisdiction of the criminal jurisdiction of the labor court, as the formation of the labor court, whether in its civil or penal jurisdiction, is formed of a tripartite body headed by a judge and the membership of a representative of the most representative workers union.
The researcher concluded:
That the criminal jurisdiction of the labor court is exercised by a non-specialist judge
Therefore, he called on the Iraqi legislator to exercise the criminal jurisdiction of the labor court by a misdemeanor court judge as it is the natural judiciary and to limit the role of the labor court to the judiciary in labor disputes on the civil side.
