The College of Law at the University of Karbala discussed a Master’s thesis on Electronic Banking Payments under Governance Rules – A Comparative Study, submitted by student Surur Ali Abbas Al-Hamdani.
The study aimed to understand the meaning of electronic banking payment and its legal characteristics, the extent to which banking systems adhere to governance principles in regulating the electronic payment process, and its impact on achieving transparency and disclosure standards between stakeholders. It also explores the legal nature of electronic banking payment.
The study concluded that there is no comprehensive definition of this term, and that electronic banking payment, like any other contract, has common characteristics, such as being a consensual contract, binding on both parties, and a compensatory contract. It also has some unique characteristics, such as being contracts concluded electronically and requiring confidentiality and trust.
