The College of Law at the University of Karbala discussed a master’s thesis for the student (Saja Adnan Jaafar) tagged with (Legal Organization for the Replacement of Members of the House of Representatives: A Comparative Study) and at the hall of the late Prof. Dr. Abbas Al-Husseini in the college.
The subject of the thesis aims to clarify the shortcomings in the Iraqi legislation with regard to the constitutional and legal organization of the replacement of members of the House of Representatives and to address the deficiency that surrounded the Iraqi Replacement Law No. 6 of 2006.
This letter reached several results, most notably that the omission of the Iraqi legislator in stipulating the legal period necessary for replacement entails that the parliamentary seat remains vacant for a period of time, and this affects the functioning of parliamentary work and other results.
The thesis concluded with important recommendations, most notably what the researcher proposed to amend the replacement law by including the determination of the legal period necessary for replacement, which is (60) days from the date of vacancy of the parliamentary seat, similar to other laws whose legislative system is close to Iraqi legislation.
