A doctoral dissertation at the College of Law at the University of Karbala discussed “Exceptions to Formality in Real Estate Transactions – A Comparative Study,” submitted by student Hussein Faisal Nima.

The study aimed to identify the philosophy and rationale behind these exceptions, how these rationales extend to other cases not provided for by law, and whether they can be used as a basis for analogy.

The study reached several conclusions, most notably that, according to the provisions of Iraqi Civil Law, a real estate sale contract is a formal contract that requires registration with the Real Estate Department to be valid. Formality here is not merely an additional procedure, but rather an essential component of the contract.
