Karbala University discusses a doctoral thesis on the role of preventive measures in protecting facilities from dangerous forces during armed conflicts
The Faculty of Law at the University of Karbala discussed the doctoral thesis tagged: “The role of preventive measures in protecting facilities with dangerous forces during armed conflicts.” The thesis was submitted by the student, “Mohammed Abdel Reda Nasser”.
The thesis aimed to provide a descriptive analysis of the preventive measures that the parties to the armed conflict should take to ensure the protection of installations with dangerous forces from the effects of military operations. Preventive measures should not be interpreted narrowly, as they include civilian persons and all civilian objects, as long as they enjoy the protection provided by international instruments.
The thesis concluded that the concept of preventive measures, the justifications for taking them, their legal basis and scope of application, and then identifying the facilities with dangerous forces and the types covered by special protection, and the nature and character of these facilities, and the search for the obligations of the parties to the conflict with preventive measures towards those facilities, which are divided into obligations that should On the attacking party take.
The researcher recommended the need to address issues that include all conflicts, regardless of whether they are of a customary nature that finds its origins in the actions and behaviors of fighters or not. Measures are to protect civilians from grave dangers or at least reduce them to a minimum. To achieve this, the parties to the conflict must exercise constant care in managing military operations, to achieve this purpose.
