The Faculty of Law at the University of Karbala discussed a master’s thesis tagged: Legal regulation of selling through seasonal liquidation (a comparative study). The thesis was presented by the student, “Maryam Abdul-Amir Rasham Yas.”
The thesis aimed to show that selling through seasonal liquidation is one of the types of commercial sales directed to the consumer public, which merchants resort to at the end of each season in an attempt to entice the consumer and to dispose of goods by announcing real reductions in the prices of goods and services.
The letter indicated that the majority of countries regulating this type of sale, whether through their commercial laws or through special laws, emphasized the need to practice selling in accordance with the established legal rules, and imposed duties on the merchant before commencing the sale and afterward in order to maintain the integrity of this type of sales.
The thesis concluded that despite the importance of this type of sales, as it is a frequent occurrence in practical life, we did not find a regulation for it within the effective Iraqi Trade Law No. (30) for the year 1984 or within an independent law other than the previous Iraqi Trade Law No. (149) for the year 1970, which It was of great interest to him because it achieves protection for the consumer and the merchant at the same time.
The researcher recommended the need to provide legislative and legal protection for the consumer and the merchant at the same time, as the consumer can claim his rights through a contractual consumer lawsuit if he is associated with the merchant with a contract. tort liability.
