The study aimed to address the issue of criminal confrontation of the crime, which differs from other crimes because it is based on the mental work and cunning of the fraudsters who commit the crime, in addition to addressing the problem of manipulating real estate, and stating the cases that call for a harsher penalty to curb the criminal tendency.
The study concluded that the crime of fraudulent disposal of real estate was not directly stipulated in the constitution and internal laws in Iraq or the comparative countries, and was mentioned among the crimes that violate honor, and that this crime has recently become rampant due to economic acceptances represented by the rise in real estate prices.
