The lecturer at the College of Law at the University of Karbala, Professor Dr. Yasser Atiwi, headed a committee to discuss a doctoral thesis in constitutional law at the College of Law – University of Kufa entitled (The jurisdiction of the Federal Supreme Court in a lawsuit for violating the constitution – a comparative study).
The thesis submitted by the student Adnan Hussein Muhammad aimed to clarify the role played by the Federal Supreme Court regarding what is attributed to the legislative authority represented by the Council of Representatives and the executive authority represented by the President of the Republic and the Prime Minister.
It also addressed the content of the violation of the constitution, its concept and cases of violation, and reviewed the legislative texts and judicial rulings issued by the constitutional judiciary.
The thesis concluded that the act of violating the constitution has a specific content, and that the violation is not limited to the head of state or the prime minister, but rather includes the House of Representatives, in addition to the fact that the violation of the constitution is not achieved by a positive act only, such as issuing legislation that violates the constitution, but rather includes negative acts (abstention), such as the prime minister, the president of the republic, or the House of Representatives abstaining from carrying out the tasks assigned to them under the constitution.
