The College of Law at the University of Karbala discussed a master’s thesis by the student (Ali Mahmoud Hamid) entitled (The Permanence of the Text in Civil Law, a Comparative Study) and in the hall of the late Professor Dr. Abbas Al-Husseini in the college.
The topic aims to demonstrate that legal texts must have a high level of accuracy in subject matter and precision in wording to ensure the continued application of these texts over long periods of time and in a manner that achieves consistency and stability in legal situations, which is reflected in the guarantee and maintenance of rights.
This thesis has reached many results, the most prominent of which is that the permanence of legal texts falls within the vocabulary of the philosophy of law, as a text is not characterized by permanence unless the conditions of permanence are taken into account in order to achieve equality between people. Also, this permanence is not limited to texts of private law, but rather extends to texts of public law.
The letter concluded with important recommendations, the most important of which is the researcher’s call to establish a department specialized in legislative affairs in the legislative authority that is responsible for formulating and reviewing the formulation of proposals and draft laws, and other proposals and recommendations.
