The topic of the study in this thesis aims to address how to establish an electronic company; which arose as a result of the development of financial services and the development of electronic commerce, the emergence of this new type of companies, which differs in terms of the means used from traditional companies, arises in a virtual and non-physical world, by opening a website via the International Communication Network, and establishing the company in an electronic manner, and dealing remotely.
The study concluded that the Iraqi legislature has not regulated the provisions of electronic companies, despite issuing laws concerned with regulating the electronic aspects of some legal acts, such as the electronic signature law, so it is a legislative deficiency.
This study recommended filling the legislative deficit of the Iraqi legislature by issuing an independent law or amending the legislation in force, including the companies law in force and amended No. 21 of 1997, which regulated the provisions of traditional companies only .
