The Faculty of Law, University of Karbala, discussed the doctoral thesis tagged: “Constitutional regulation of restrictions on the freedom of partisan activity – a comparative study.” The thesis was presented by the student Maytham Hussein Al-Shafei.
The thesis aimed to show that there must be a guarantee and that the basic guarantee for the effective protection of liberties, including the freedom of partisan activity, must start from the individuals themselves before any other party because there is no point in any activity placed to protect freedoms, including the freedom of partisan activity unless individuals adhere to it and unless They have sufficient political awareness and awareness to exercise freedoms, including partisan activity, within the limits of the constitution and the law.
The researcher reached a number of results and proposals, the most important of which is that the establishment of the society itself contradicts the recognition of the absolute freedoms recognized for individuals. Therefore, regulating freedoms in their view is essential, as they are equal in their rights. However, if there is an opinion that exaggerates the necessity of freedoms To the point of saying that freedoms without regulation are mere promises, and therefore when political parties practice their partisan activity, it responds to restrictions just as it responds to other public freedoms.
