Karbala University discusses a master’s thesis on economics in civil lawsuit procedures
The Faculty of Law at the University of Karbala discussed a master’s thesis tagged: “Economy in Civil Procedure Procedures” (a comparative study). The message was submitted by the student Ahmed Safaa Mahdi.
The study aimed to show that the main purpose of the procedural laws is to guarantee the rights of individuals, and this matter is achieved only if the rights reach them quickly, through the economy in the civil lawsuit procedures. Where it is noted at the present time that the litigation procedures are slow, which means that the right does not arrive quickly enough to guarantee the rights of the litigants.
The study concluded that the reason for this slowness is due to two main reasons: the first is the excessive formality that the pleadings law adheres to, and the legislative void of some texts that, if any, would have expedited the case and resolved it quickly. The second reason is due to the judiciary, which stuck to formalism to a large extent when it was possible to get rid of it.
In conclusion, the researcher reached a number of results and proposals, the most important of which is that the economy in civil lawsuit procedures contributes to not delaying the adjudication of the lawsuit and at the same time giving everyone his right with the least expenses and an appropriate speed.
