The head of the Private Law Department at our college, Assistant Professor Dr. Ishraq Sabah, and Professor of Commercial Law, participated in a doctoral dissertation committee on “Legal Regulation of Start-Ups: A Comparative Study,” presented by private law student Mohammed Kazem Hadi.
The study aimed to understand the legal regulation of startups, define their concept, legal nature, and the foundations upon which they are based, as well as how startups are established and operated, and the mechanisms for supporting and financing them.
The study reached several conclusions, most notably that legal jurisprudence in Iraq has not addressed the topic of startups, while Algerian legal scholars have shown widespread interest in this topic. Furthermore, since startups are a newly emerging commercial topic, Iraqi law has not regulated their provisions, whether through a specific law or regulation or through legal provisions in existing legislation, such as the current Companies Law.
