Our college hosted Assistant Professor Dr. Nuha Khalid Issa, a professor of commercial law at the College of Law at the University of Babylon, to participate in the discussion committee for a master’s thesis at the College of Law at the University of Karbala, entitled “The Legal System of International Trademarks – A Comparative Study.” The thesis was submitted by student Marwan Ghaleb Obaid.
The study aimed to clarify the legal aspects of trademarks, their protection and registration, and the availability of formal and substantive conditions for addressing legislative shortcomings in Iraqi trademark law to clarify the position of comparative laws.
The study concluded that Iraqi law did not define international trademarks in the Law of Trademarks and Commercial Information. However, it granted protection even if they were not registered in Iraq, stipulating that the country of origin be a member of the Paris Union, the World Trade Organization, or any agreement to which Iraq is a member, or that Iraq be treated reciprocally. Furthermore, joining the Madrid System for International Registration requires countries to amend their laws to comply with the Madrid Agreement and its system.
