Our college hosted Assistant Professor Dr. Ihda Bassem Daoud, a professor of commercial law at the College of Law at the University of Kufa, to participate in the committee discussing a master’s thesis on electronic banking payments under the rules of governance – a comparative study, submitted by student Surur Ali Abbas Al-Hamdani.
The study aimed to understand the meaning of electronic banking payments and their legal characteristics, the extent to which banking systems adhere to the principles of governance in regulating the electronic payment process, and their impact on achieving transparency and disclosure standards among stakeholders. It also examined the legal nature of electronic banking payments.
The study concluded that there is no comprehensive definition of this term, and that electronic banking payments, like any other contract, share common characteristics, including being a consensual contract, binding on both parties, and compensatory. It also possesses some unique characteristics, such as contracts concluded electronically and requiring confidentiality and trust.
