A doctoral thesis in the College of Law at the University of Karbala discussed the constitutional guarantees for the neutrality of the military institution under the Constitution of the Republic of Iraq for the year 2005 – a comparative study, submitted by the student Ihab Kamel Shaheen.
The study aimed to know the concept of neutrality of the military institution, and the manifestations of this neutrality, in addition to knowing the bodies that monitor the performance of the military institution and ensure its compliance with the provisions of the constitution.
The study recommended the necessity of giving the parliamentary councils full authority to discuss the budget of the military institution on a detailed basis and not a single number, and activating the role of the constitutional judiciary in prosecuting members of the executive authority in the event of their breach of constitutional principles, including committing acts that would breach or violate the principle of neutrality of the military institution.
