The Faculty of Law, University of Karbala, discussed the doctoral thesis tagged: “The supposed solidarity of debtors in the commercial obligation (a comparative study)”. The thesis was submitted by the student: “Ali Jassim Muhammad”.
The thesis aimed to show that the specificity of the trade law and its independence from civil law is a result of its characteristics, which makes it have an environment different from the civil environment, and the commercial environment is based on two pillars: speed and credit, and its existence is not imagined without their availability, and commercial credit is the backbone of commercial life, so traders innovated There are several systems to provide it, including the supposed solidarity of the debtors in the commercial obligation, which effectively contributes to providing confidence, which makes the creditor grant the debtors a deadline for payment based on the assumption of their solidarity towards him.
The researcher reached a number of results and recommendations, the most important of which is that the assumption is dictated by some justifications related to the necessity of the availability of the commercial credit component in the commercial environment and the stability of transactions. Society through its contribution to economic prosperity as a result of that increase in commercial activity.
