Master’s thesis in the Faculty of Law about the wife’s work and its impact on marital rights
The Faculty of Law, University of Karbala, discussed the master’s thesis tagged ((The wife’s work and its impact on marital rights – a comparative study -)). The message was submitted by the student Nada Dhafer Muhammad Ali.
The thesis aimed at explaining a global issue that has increased in interest in the modern era and was also concerned with Islamic law before, namely the work of women, which sparked widespread controversy and still raises this controversy among researchers and specialists in various fields of life. The right and how controls and areas were established for it and how it equalized between women and men in remuneration, as well as one of the most important things that must be clarified, is to know the real impact of women’s work on their marital rights and duties legally and legally, with an explanation of the most important of those rights for women and men.
The researcher reached a number of results and proposals, the most important of which is that women’s work is defined by legal and legal controls that aim at making a woman’s work ideal that is acceptable to Islamic law and societal values, including that women abide by the etiquette of going out in a legal dress and the permission of her guardian and reconciling between women’s work and family duties. The researcher also called on the Iraqi legislator to stipulate in the Personal Status Law that the wife’s requirement to work in the marriage contract, or if he marries her while she is a worker, or if she stipulates work after marriage and the husband agrees explicitly or implicitly, then this condition is a considered and binding condition for the husband.
