The Faculty of Law at the University of Karbala discussed the doctoral thesis tagged: “(Real estate registration in the legal case without compensation – a comparative study). The thesis was submitted by the student: “Roaa Salman Khalif.”
The thesis aimed to determine the legal bases that secure the stability of dealing in the real estate registry through the establishment of a procedural legal system characterized by publicity, publicity, and formality, and the protection of the rights resulting from dealing with it. Awad, rules that fit the legal nature of each incident, and these systems had a key role in determining the legal identity of the property in a way that makes the owner and the dealer in the property reassured and safe, based on the restrictions and information recorded with utmost accuracy in the real estate registry in accordance with the personal and in-kind system
The thesis reached a number of results and proposals, the most important of which is that the real estate laws emphasized the inadmissibility of appealing forgery or the shame of real estate bonds. The reason lies in the transfer of rights to registration, and that the registration process is preceded by many procedures that surround the real estate dealer with sufficient information to indicate the validity of the registration and also with the aim of stabilizing real estate dealings and strengthening credit And the economy. It also recommended the real estate legislator to reconsider the issue of auditing real estate transactions before the registration process and not after it, in order to contribute to reducing the cases of invalidation of real estate registration bonds as a result of errors resulting from registration processes and cases of invalidating and referring to the facts, which leads to more stable transactions.
