Karbala University College discusses a master’s thesis in the legal organization of the resignation of the Prime Minister
The Faculty of Law at the University of Karbala discussed a master’s thesis entitled “The Legal Regulations for the Resignation of the Prime Minister – A Comparative Study”
The thesis was submitted by the student Hashem Ali Hassan. This study aims to address one of the most important legal problems facing the organization of public authorities, as some comparative constitutions dealt with the issue of resignation, but they did not undertake to address all the problems. It is related to special texts that the Iraqi constitution did not address. Hence, there was a need to study how the Prime Minister submitted his resignation in accordance with Iraqi law. We did not find a constitutional organization for it in terms of the provisions or effects associated with it, and studying the problems of transforming the government into a caretaker government in the application of the principle of ministerial solidarity.
The study concluded that although the Iraqi constitution in force regulates public authorities, it was not spared from the legislative vacuum, especially with regard to the resignation of the Prime Minister and the organization of the competent authority to adjudicate in it, and its effects. The study also concluded to determine the appropriateness of the supplementary texts of the constitution that regulate the work of the authorities, including the internal regulations, in dealing with this subject.
The researcher also suggested a number of proposals, including the need to address the shortcomings in the legislative texts presented by the Iraqi legislator in regulating the prime minister’s resignation.
