The College of Law / University of Karbala is discussing a master’s thesis on the effect of surveillance with digital cameras on criminal evidence.
The Faculty of Law at the University of Karbala discussed the master’s thesis tagged: Criminal Responsibility for Predicting the Crime, the Impact of Surveillance with Digital Cameras on Criminal Evidence / Comparative Study, on the hall of the late Dr. Abbas Al-Husseini in the college.
The message was presented by the student Ahmed Mahdi Baqer, and the message aims to demonstrate the impact of surveillance with digital cameras on criminal evidence as one of the important topics in theory and practice, as it is directly related to the lives of individuals and the sanctity of their private lives on the one hand, and the rapid developments in these modern technologies that have spread in society Significantly the other hand. The study confirmed that modern technologies in monitoring and filming confront every person working in the law, whether he is sitting on the court bench or defending a right holder, as it is an effective tool in achieving justice and in uncovering and appreciating the truth.
The message reached several conclusions, including: The absence of a legal regulation for surveillance with digital cameras, despite the rapid development and widespread in Iraq in this field. Likewise, the Iraqi legislature has not regulated procedures for benefiting from surveillance in digital cameras in monitoring traffic violations.
The study recommended that the Iraqi Traffic Law No. 8 of 2019 should include the following text: Article (28) First – C The Traffic Directorate may use modern surveillance devices to monitor traffic violations and notify violators of the penalties imposed in accordance with the provisions of this law through modern means of communication.
The study also recommended amending the text of Article 213 of the Iraqi Criminal Procedure Code by adding a paragraph to it as follows: Approving the photo recording of surveillance cameras as evidence to prove the crime in case the image is clear and the court is convinced that it will not be subjected to distortion and manipulation.
