The College of Law is discussing an MA thesis on Criminal Responsibility for Preempting Crime
The College of Law at the University of Karbala discussed a master’s thesis in the Public Law Branch of the student Ruaa Adnan Hassan, tagged: Criminal Responsibility for Predicting Crime / Comparative Study, at the late Dr. Abbas Al-Husseini Hall in the college.
The discussion committee consisted of:
1- Prof. Diaa Abdullah Al-Asadi / Chairman.
2- Prof. Dr. Adel Kazem Saud / Member.
3- Prof. Dr. Khaled Khudair Daham / member.
4- Assistant Professor Dr. Haider Hussain Al-Kuraity / Member and Supervisor.
The message aims to show the role of preemption in the occurrence of the crime as an indirect effect, which required criminal legislation to criminalize such prejudice, but within a specific scope represented by state security crimes because of their seriousness and prejudice to the existence of society and its constitutional powers.
The message was divided into three chapters, the first dealt with the definition of preemption, while the second chapter was devoted to discussing the material and moral elements of preemption, while the third and final chapter dealt with the penal liability for preemption and the penalties decided in this regard.
The letter reached several proposals, including: The necessity of delineating the boundaries between favoring crime as a prohibited activity and expressing opinion as a legally guaranteed right. The necessity to include in the penal code a criminal text in favor of suspending the constitution without constitutional mechanisms. The importance of amending the Iraqi Counter-Terrorism Law No. (13) of 2005 to explicitly criminalize advocacy of terrorism because of this behavior’s role in committing the terrorist crime and in line with recent trends in Arab and international anti-terrorism laws. Accelerating the passage of the Information Crimes Act and including an explicit provision in it criminalizing inciting sectarian or sectarian strife or stirring up strife through the use of electronic means.
