The subject of the research is one the important topics at all levels, legal, economic, and political – the researcher tried through it to address what are the guarantees through which it is possible to create an attractive environment for foreign companies to invest in Iraq in the energy sector. Changing or amending the relevant legislation in a way that harms the foreign party. As for the other guarantees, it is represented in resorting to arbitration and alternative means away from the dominance of the national judiciary and pushing for judicial immunity that the state can uphold. The researcher reached a number of results and recommendations through the thesis.
