The Faculty of Law, University of Karbala, discussed a master’s thesis entitled “Traffic Criminal Policy – a legal study – the thesis submitted by the student, “Time of a Quality Journey”.
The thesis aimed at identifying the criminal policy of traffic crimes and their consequences, working to direct the legislator’s attention to the shortcomings in the legislation, or in the actual application of the law, and discovering the most important gaps that have not been remedied by the legislator, and that would weaken that system, to reach Texts and procedures that ensure the protection of lives and money, as well as work to reduce the traffic crisis on the roads.
The study also showed that criminal policy, in general, is based on two distinct ideas: the first is the philosophical thought, and here it determines the state’s right to prevent crime and punish it, and the second is the political thought, which determines the nature of the individual’s relationship with the state, as it relates to the preventive aspect in the traffic field. They are related to the procedural rules for the criminal case in those crimes.
The researcher reached a number of results and recommendations, the most important of which is that the traffic preventive policy has a number of results, including an attempt to avoid the occurrence of traffic crime before it occurs, that is, to prevent it from occurring in the first place, and this is the narrow meaning of the traffic preventive policy, and also, working to combat the primary factors that are the cause of The presence of the criminal personality, and work to find successful preventive methods through which you can control the crime.
